La Corte di Cassazione, Sez. I Civile, con sentenza n. 8445 del 01.04.2008, a conferma di precedenti decisioni in materia, ha stabilito che "Se il praticante avvocato, svolge attività extragiudiziale, ne risponde personalmente, senza che possa ipotizzarsi nullità del contratto di prestazioni professionali" cfr. Cass. Civ., Sez. II, 16658/07- Cass. Civ., Sez. III, 9238/07
