DIVORZIO: IN CASO DI CONTESTAZIONI SUI REDDITI, IL GIUDICE NON E’ TENUTO A DISPORRE INDAGINI TRAMITE LA POLIZIA TRIBUTARIA

L’esercizio del potere officioso di disporre, tramite la polizia tributaria, indagini sui redditi e sui patrimoni dei coniugi e sul loro effettivo tenore di vita rientra nella discrezionalità del giudice del merito e non può essere considerato come un dovere imposto sulla base della semplice contestazione delle parti in ordine alle loro rispettive condizioni economiche.
E' la Cassazione (Sez. I Civile n. 593 del 14 gennaio 2008) ad affermare che si tratta soltanto di una facoltà discrezionale.
