Il Tribunale Ordinario di Catanzaro, Sez. II, con ordinanza pronunciata in data 22.12.2010, ha statuito che "la molestia, presupposto dell'azione di manutenzione, consiste in una deminutio del possesso esercitato, che non lo esclude, ma ne determina un peggioramento qualitativo, rendendo più gravoso e difficoltoso l'estrinsecarsi della posizione del possessore".
